Viacom appeals YouTube’s trial verdict
after losing the trial and not getting a billion dollars compensation from the video sharing site – YouTube for infringement of copy rights, Viacom officially appealed the ruling.
Viacom is appealing the ruling in the trial it ran against YouTube according to which the video sharing site owned by Google, does not have to pay it a billion dollars compensation for infringement of copy rights.
Viacom, that holds among others MTV and comedy central TV channels in paramount sued YouTube in 2007 for over a billion dollars a year after it was acquired by Google.
According to Viacom, internal correspondence between YouTube founders presented at court proved that the video sharing site planned to profit from these infringements. YouTube’s legal advisor, wrote on the company’s blog that these are a few single lines out of many letters that were taken out of context. YouTube claimed along the trial, in her defense that it removes infringing content as soon as it is notified according to US law, the DMCA and therefore it is entitled to the “safe harbor” defense.
A NY court accepted Google and YouTube’s claims in June and rejected Viacom’s suit. Yesterday (Wednesday), according to a report by cnet, Viacom served the court papers and made the appeal official after declaring it will do so when it lost the trial.
